Court Appointed Investigator

When a defendant is arrested in the United States, whether it is a state or federal case, the defendant is entitled to have an attorney. In most major felony cases an attorney may hire defense services to aid in the defense of the client. Defense services include but are not limited to investigators, paralegals, interpreters, medical and psychological specialists, and more.

If a defendant has wealth, they will have all the attorneys and specialists needed.  If the defendant does not have a way to pay the attorney, he will be given one by the court. But what people do not know is that they are entitled to additional defense services if needed. When the court appoints an attorney to a case with a major felony, the attorney may make a request for additional court services. All the attorney needs to do is file a Widdis motion and ask for the judges approval. If your attorney is not familiar with this we will help assess the need of additional defense services.

An attorney gets assigned a criminal defense investigator to reverse-engineer the case and discover precisely where law enforcement came up with their decision to file the charges in the first place. Our role as investigators is to attempt to discover additional information that will help the defendant’s case.

From there, we sit down with the attorney and the client. Together we review the indictment, converse with the defendant, see what they can tell us, and go through that entire process. After that, the defendant goes on with their life and contacts me when they have questions, when they’re freaking out, when they need a shoulder to cry on, etc.

In the meantime, the prosecutor is also looking at their side of the case, making offers to the defense attorney to see if they can come up with some kind of plea bargain. Whenever the prosecutor offers a plea bargain, the defense attorney presents it to the client, and we investigators are often present as well.

The defendant has the opportunity to accept the plea bargain or decline it. If they decline all plea bargains, that is when we go into trial mode.

We sit down and really go through the investigation, following the footsteps of law enforcement, looking for inconsistencies, differences, flaws, mistakes, or just blatant misdirection.

During that time, we process our reports and supply them to the attorney, who will then figure out the best course to take during trial to fight for the defendant’s rights.

Once the strategy is devised, we investigators are pulled in again to contact and subpoena witnesses; to gather information, knowledge, and case history; etc. We may also be called on as witnesses for the defense.

We are fully available during the trial, working alongside every step of the way. We are not done with the case until the client is either exonerated or sentenced.
